TruEdge Sports Waiver and Release Agreement

I/we (the Parent/Guardian completing registration and the Participant being registered) hereby acknowledge and accept the terms and conditions governing participation in any TruEdge Sports camp, event, or related activity.

By completing the online registration process for a TruEdge Sports event, the Registrant (the individual completing the registration) acknowledges, accepts, and agrees to all terms of this Waiver and Release on behalf of the Participant they are registering. The Registrant affirms that they have the legal authority as the Participant, or as the Parent/Guardian of the Participant, to enter into this Waiver and Release.

If the Registrant willingly brings another individual to participate in the event who was not properly registered, the Registrant acknowledges that TruEdge Sports cannot reasonably distinguish between properly registered and unregistered participants at the event. Accordingly, any such additional Participant will also be deemed subject to this Waiver and Release in its entirety.

I certify that the Participant is physically fit to engage in all Event activities and that I know of no restrictions, impairments, or conditions that would limit or prevent safe participation. I understand that TruEdge Sports will not conduct medical examinations and will rely solely on the information provided by me.

In the event of a medical emergency, I authorize the Released Parties to act in their best judgment to secure necessary medical care, including hospitalization, and I assume full financial responsibility for such care.

I represent that the Participant is covered by adequate health and medical insurance for all Event-related activities. I agree that my insurance shall serve as the primary coverage for any medical treatment. I further acknowledge that the Released Parties do not assume financial responsibility or liability for any injury, accident, or illness suffered during participation.

The Participant agrees to comply with all Event rules, policies, and instructions, whether written, oral, or implied. TruEdge Sports reserves the right, in its sole discretion, to remove any Participant who fails to comply, without refund or credit.

I further release the Released Parties from liability arising from the Participant’s own acts, failures to act, or disregard of Event rules.

I understand and acknowledge that participation in the Event carries significant risks of injury, illness, disability, or death. These risks include, but are not limited to: athletic drills, contact with other participants, use of facilities and equipment, transportation, weather, and acts of negligence by participants, coaches, staff, or others.

These risks extend to activities before, during, and after scheduled Event times, beginning with arrival at the Event facility through departure.

I knowingly and voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties.

I understand that spectators, including but not limited to parents, guardians, family members, and guests, are permitted to observe the camp at their own risk. I acknowledge that TruEdge Sports, its owners, staff, sponsors, partners, and affiliates (collectively, “the Released Parties”) are not responsible or liable for any injury, loss, or damage suffered by any spectator during or in connection with the camp. By allowing my child or dependent to participate, I agree to release and hold harmless the Released Parties from any claims or liabilities that may arise from the attendance or actions of any spectator.

I acknowledge that all individuals who volunteer or assist at the camp do so at their own risk and are not employees or agents of TruEdge Sports. I understand that the Released Parties are not liable for any injury, loss, or damages suffered by volunteers in connection with their participation. Volunteers, by choosing to assist, agree to release, indemnify, and hold harmless the Released Parties from any and all claims, demands, or causes of action arising from or related to their volunteer activities.

To the fullest extent permitted by law, I, on behalf of myself and the Participant, hereby release and forever discharge the Released Parties from any and all claims, liabilities, damages, or expenses, including those arising from negligence or otherwise, related to the Participant’s involvement in the Event. I further agree to indemnify and hold harmless the Released Parties from any claims, damages, or costs (including attorney’s fees) brought by third parties arising from the Participant’s conduct, acts, or omissions.

I grant TruEdge Sports and its sponsors the irrevocable right to use the Participant’s name, likeness, voice, image, and biographical information in any media, worldwide, for promotional, commercial, or educational purposes, without compensation. I waive any claims related to such use.

To the fullest extent permitted by law, the total liability of the Released Parties for any claims arising from or related to participation in the Event shall not exceed the total compensation paid by me for the Participant’s registration. In no event shall the Released Parties be liable for indirect, incidental, consequential, or punitive damages.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

This Agreement shall be governed by the laws of the State of Georgia, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia, and the parties consent to jurisdiction therein.

The Registrant represents and warrants that all information provided during registration is complete, accurate, and truthful, including but not limited to the Participant’s name, age, date of birth, medical conditions, and insurance information. The Registrant acknowledges that TruEdge Sports reasonably relies on the accuracy of this information to ensure the safety and proper administration of the Event.

In the event of falsified, omitted, or incomplete information, the Participant shall remain fully bound by the terms of this Waiver and Release. Any misrepresentation shall not relieve the Participant, Guardian, or Registrant of responsibility or liability, and the Waiver shall apply to the actual Participant in attendance regardless of the information submitted.

I HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND AGREE THAT BY SIGNING OR COMPLETING ONLINE REGISTRATION I AM WAIVING SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN AND REGISTER FREELY, VOLUNTARILY, AND WITH FULL KNOWLEDGE OF ITS SIGNIFICANCE.
